ADP Workforce Now® General Description of Products and Services

The following is a general description of the ADP Workforce Now® Products and Services. The descriptions set forth below are intended to be general in nature, do not in any way reflect the roles and responsibilities of any party with respect to the ADP Products and Services and are not inclusive as to the total functionality of any of the ADP Products and Services. These descriptions are applicable to the current version ADP Workforce Now only; feature functionality for clients using a prior version of ADP Workforce Now may differ. ADP reserves the right to modify any of the terms set forth below at any time, without notice. ADP Workforce Now is ADP’s trademarked, branded, web-based payroll, human resources and benefits technology.

ADP Workforce Now Payroll Solutions

ADP Workforce Now Payroll solutions are web-based payroll processing services that include gross-to-net payroll and tax calculations for each employee; online pay statements; print and deliver checks or deliver payroll by direct deposit or with ADP’s Wisely payroll pay card; and provide online management reports. Paychecks can be issued weekly, bi-weekly, monthly, semi-monthly, or annually. ADP prepares, files, and deposits federal, state, and most local taxes, while also issuing the required monthly reporting to relevant tax authorities. Clients can choose from two payroll solutions as described below – Essential Plus Payroll and Enhanced Payroll.

Essential Plus Payroll

Description of Services

  • Tax Filing and Payment Service – ADP calculates, files, deposits and reconciles payroll taxes including federal income and unemployment taxes, social security/Medicare taxes, state income and unemployment taxes, state disability insurance and most local income taxes.
  • Payment Services – ADP makes payments (either electronically or by check payments) to third parties on a client’s behalf or at its direction.
  • ADP Mobile Access
  • Online Pay Statements – Employee access to wage/salary data. Employees can access images of their pay and earnings statements (from the time service begins) and Forms W-2 (from the time service begins).
  • Employee & Manager Self-Service – Manager and employee access to make updates to direct deposit information, tax changes and personal information.
  • New Hire Reporting – ADP automatically transmits new hire data to the appropriate state agencies and provides management reports for all filings, including concise management summaries that verify reporting status by employee.
  • Wage Garnishment Processing (WGPS) – ADP calculates, prioritizes, deducts and disburses court-ordered garnishments and tracks changing legislation that can affect compliance.
  • Online Access to Standard Reports with 7-year Archive
  • General Ledger Solution – This is hosted application that takes client payroll data and reformats it into an import ready format that can be accepted into most financial software packages.
  • Employment Verification Services – Management of employment and income verification requests.
  • Group Term Life Calculation

Enhanced Payroll

  • All Essential Plus Payroll features, plus
    • ADP Portal with Customized Content

Additional payroll-related services that may carry separate fees include:

  • Preparation of Year-End Forms W-2 and W-2C; Forms W-2 Delivery
  • Preparation of Year-End Information Forms 1099, Forms 1099 Misc.
  • Banking Options
    • Direct Deposit - ADP sends employee payroll direct deposit information to the employee's bank provided a relationship exists between the client's bank and the ADP region.
    • Full Service Direct Deposit (FSDD) - ADP, via a partner bank that functions as ADP's financial institution, debits a client's bank account and credits an employee's bank account for the amount of the direct deposit.
    • TotalPay® - a comprehensive payment solution that features Full Service Direct Deposit (FSDD), ADPCheck™ and Wisely Pay Card.
    • ADPCheck™ – traditional paper payroll checks that are delivered stuffed, sealed, and signed by an ADP officer. Client's logo and corporate officer's signature can be added for a nominal fee. ADPChecks are drawn from an ADP account so client's bank statement reflects only one debit per net payroll instead of one for each individual paycheck.
    • Wisely Pay Card – paperless solution that loads payroll funds onto employee debit cards, which can be used at virtually any location that accepts Visa® debit cards.

ADP Workforce Now HCM Solutions

ADP's web-based, full-featured, Human Capital Management (“HCM”) solution(s). ADP Workforce Now HCM is fully integrated with the ADP Workforce Now Essential Plus and Enhanced Payroll modules.

ADP Workforce Now Time & Labor Management Solutions

ADP Workforce Now Essential Time

  • Time Data Collection – Employees enter time and attendance information via online timesheets; timeclocks (either leased or purchased from ADP), Web clock, telephone (IVR) or via ADP’s mobile applications.
  • Time and Attendance Management – Time and attendance data is continually and automatically summarized, rules are applied and calculations are performed to maintain accurate records for the purpose of managing employees and feeding payroll.
  • Scheduling – Employee schedules with filtering, editing and auditing capabilities. Employee time off can also be viewed and managed.
  • Standard Reporting including PTO Management & Reporting– Monitor and analyze time and attendance with reports on timecards, payroll, attendance, schedules, and weekly/monthly hours of service.
  • Labor Analytics – Key performance indicators such as labor cost, overtime and absenteeism
  • Customized Content (when not already included w/ Payroll) – the ability to customize your company’s logos, announcements, etc.
  • Paid Time Off (PTO) Accruals Engine

ADP Workforce Now Enhanced Time (Hosted or Premise-based)

  • Time Data Collection – Employees enter time and attendance information via online timesheets; timeclocks (either leased or purchased from ADP), Web clock, telephone (IVR) or via ADP’s mobile applications.
  • Time and Attendance Management - Time and attendance data is continually and automatically summarized, rules are applied and calculations are performed to maintain accurate records for the purpose of managing employees and feeding payroll.
  • Scheduling – Basic employee scheduling, via the time off request template, includes assigning people to work specific hours/shifts, communicating those schedules to employees, and features for viewing/maintaining those schedules on a regular basis. More advanced capabilities are available for complex scheduling scenarios. This includes best fit scheduling where the system can use algorithms to suggest the best person for the shift based on availability, preference, seniority, proficiency, and demand. Features are also available to help employees swap shifts, for managers to monitor and approve overtime, and to enforce work rules when creating schedules.
  • Attendance Points / Occurrence Tracking – Manage attendance policies online, and track absence points/occurrences and send disciplinary notices.
  • Leave Management – Tracking and administration of multiple leave types, including Short- and Long-term disability, Military Leave, FMLA and others.
  • Leaderboards and Challenges – Feature that utilizes game design for the purpose of rewarding/recognizing employees, managers, and teams for positive job performance and adhering to an organization’s time and attendance policies and procedures.
  • Grant and Project Tracking – Monitor the status of projects, and grants to simplify reporting and tracking. Track project details and dates, assign non-labor resources, capture internal and external rates, define work breakdown up to four levels, and allocate paycodes to specific projects and grants.
  • Standard Reporting – Monitor and analyze time and attendance with reports on timecards, payroll, attendance, schedules, and weekly/monthly hours of service.
  • Labor Analytics – Key performance indicators such as labor cost, overtime and absenteeism.

Web Hosting Services

The following information applies to hosted ADP Workforce Now Payroll Solutions, HCM Solutions, and, if applicable, Time & Attendance Solutions (collectively, the “Hosted Products”).

  • ADP shall provide the hosting environment(s), including hardware and software, required to host the site(s) for the applicable Hosted Product (the “Systems”) and the operation and required maintenance of such Systems. The Systems may be used to provide similar services to other clients and client acquires no rights therein.
  • The Hosted Product(s) licensed to Client shall be deployed at Uniform Resource Locators (URLs) to be selected, registered and owned by ADP.
  • In the event that ADP discovers and/or Client reports to ADP through its support line that a System for a Hosted Product licensed to Client is experiencing an outage or that a Hosted Product licensed to Client is experiencing operational issues, ADP will resolve such issues as soon as possible, giving priority to outages and significant operational issues.
  • ADP targets system availability for each Hosted Product licensed to Client to be available 99.5% of the time for the hours outside of the specified ADP Product Maintenance Windows in Table 1 of paragraph E below, except for additional required infrastructure maintenance (described below) and any loss or interruption of the system due to causes beyond the control of ADP or which are not reasonably foreseeable by ADP, including, but not limited to, interruption or failure of telecommunication or digital transmission links, Internet slow-downs or failures or unauthorized intrusions. In order to perform required system maintenance, the system may not be available for (a) hours specified in Table 1 below and (b) any hours required to perform additional infrastructure maintenance that cannot be completed during standard maintenance windows (and when Client's use of the system will be directly impacted, ADP will notify the Client of such unscheduled system downtime with as much advance notice as possible following ADP’s identification of the need for such unscheduled downtime).

Except as set for below, the Hosted Products may not be used or accessed from outside the United States unless otherwise authorized by ADP or in any way that violates any applicable international, federal, state or local laws and/or regulations.

ADP Workforce Now Approved Country (Global Suitability) List

For ADP Workforce Now, the ADP Workforce Now HR and/or Talent modules (but specifically excluding Document Cloud and Onboarding services), may be used by Client’s US based practitioners and managers to track international employees in the 54 suitable countries on the Approved Country List shown below. For the avoidance of doubt, the ADP Workforce Now HR and/or Talent modules are intended to be used within the United States only and for tracking purposes only when used as a Client’s HR global system of record. ADP makes no representation or warranty that access and use of any of the Services from outside the United States by Client employee, managers, and/or other parties who are not physically located in the United States comport with any local laws, regulations, or directives in any other country. Should any Client seek to access and use these Services outside of the United States, the Client, and not ADP, shall be solely responsible for compliance with all laws and governmental regulations required under any applicable employment, labor and taxing laws and regulations.
